After the Senate passed HB 123 yesterday, March 31, the House then approved the Senate version. House Bill 123 is now with Governor Kemp for his signature. 

The new law will provide for a pre-trial hearing, and it also lowers the standard of proof from "beyond a reasonable doubt" to "preponderance of the evidence." After many years of advocating, people with intellectual disabilities in Georgia can now be reasonably expected to prove that disability in court.
